Terms of Use

Machine translated. The German version is authoritative.

§ 1 Scope and operator of the platform

(1) These Terms of Use govern the use of the platform bildungszeit.app (the “platform”) by users who search for, compare and enquire about Bildungsurlaub courses, that is courses eligible for statutory educational leave (the “users”).

(2) The platform is operated by Endrik Reimer, trading as “Bildungszeit”, Mühsamstraße 72, 10249 Berlin (“Bildungszeit”, “we”).

(3) The use of the platform as a course provider is governed not by these terms but by the Provider Terms.

§ 2 What the platform does

(1) Bildungszeit is an intermediation and process platform: we help you find courses recognised for educational leave, send a participation enquiry to the provider, prepare and transmit the application to your employer, and request the booking from the provider.

(2) We are not a party to the course contract. A contract on course participation is concluded exclusively between you and the respective provider, outside the platform. Payment for the course does not run through us either; we are not a payment service provider.

(3) Whether you are granted leave and whether a course is recognised is not decided by us. We give no guarantee that a provider will confirm an enquiry, that an employer will consent or that a booking will come about.

(4) The course list is sorted by how well courses fit the answers you have given, as long as you do not choose a different sort order, such as by price or rating. Courses that match all of your filter settings are shown before courses that do not match individual filter settings; such courses appear only as a supplement and are marked as such. In a search, courses that match the search term particularly closely may appear before courses with a higher fit, and we may show a course that you open via a shared link first. Which main parameters determine the order, and how they are weighted relative to one another, is explained in the How we sort section of our FAQ.

§ 3 Costs

Use of the platform is free of charge for users. Providers pay us a commission for bookings that we broker. In the course search we only show courses from providers who have agreed to this with us.

§ 4 No legal advice; accuracy of information

(1) The platform is a tool: it supports you in organising information, keeping track of deadlines and preparing your application. It does not replace individual legal advice. We do not review your individual case from a legal perspective.

(2) We compile information on recognitions, deadlines and procedures with care; it originates from the providers' statements and from publicly accessible sources and may change. What is authoritative is always the official information of your federal state, your employer and the provider. Please check the information material to your decision (in particular recognition, date and price) yourself before booking. Our liability under § 9 remains unaffected.

§ 5 Application to your employer

(1) On your instruction we transmit your application electronically to the contact person you have named at your employer and log delivery, opening and decision. Once a decision has been made or you claim in the dashboard that approval is deemed granted, we send you this information as a delivery log by email.

(2) Whether and in what form your employer accepts electronic applications, and which deadlines apply, is governed by statute, by collective or individual employment agreement and by your employer's practice. Please make sure that the contact person you name is the responsible one, and observe the application deadline of your federal state. We cannot guarantee timely receipt by the responsible recipient. Our liability under § 9 remains unaffected.

§ 6 Your obligations

(1) Please provide truthful and complete information in enquiries and applications; you are responsible for the accuracy of the data you enter (in particular the details about your employer and the contact person).

(2) Do not use the platform abusively. Unlawful, insulting or deceptive content in messages, the mass submission of enquiries without any intention to participate and automated access outside the intended use are in particular not permitted.

(3) Detected contact details in messages you send to providers via the messaging function are masked automatically before delivery until you have sent a booking request for the course; the detection is rule-based and may miss individual details. With the booking request, the provider receives your name and your email address; after that, messages in the conversation about that course are delivered unmasked in both directions. If you report a problem with a booking, your description is passed on to the provider unchanged, with your email address as the reply address.

§ 7 Content, moderation and reports

(1) Course listings and their content come from the providers. We review courses editorially before they are first published; we do not undertake a legal review.

(2) If content or conduct infringes these terms or applicable law, we may restrict or remove content and block access. In doing so we act diligently, objectively and proportionately. Such a measure is decided by a human being. We inform those affected together with a statement of reasons and point out the options for challenging it.

(3) You can report unlawful content to us via the reporting channel described in the legal notice.

§ 8 Availability

We endeavour to provide uninterrupted operation, but we do not owe any particular availability. Maintenance, further development and faults may lead to temporary restrictions.

§ 9 Liability

(1) We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and other mandatory statutory provisions, as well as in the event of fraudulent concealment and within the scope of a guarantee expressly assumed by us.

(2) Otherwise, in cases of ordinary negligence, we are liable only for the breach of material contractual obligations (obligations whose fulfilment is what makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical of this type of contract. Liability under paragraph 1 remains unaffected.

(3) We are not liable for the providers' content, for your employer's decision or for the conclusion or performance of course contracts; paragraphs 1 and 2 remain unaffected.

§ 10 Data protection

Information on the processing of personal data can be found in our privacy policy.

§ 11 Changes to these terms

We may change these terms for the future; we do not introduce fees in this way. A changed version applies to everything you submit via the platform after its publication, provided we refer you to the terms when you submit. For transactions already in progress at that time, the previous version continues to apply insofar as the changed version would put you at a disadvantage. If you do not agree with a change, you can end your use at any time and request the deletion of your data.

§ 12 Final provisions

(1) German law applies. If you are a consumer with your habitual residence abroad, mandatory consumer protection provisions of your country of residence remain unaffected.

(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

(3) These terms are drawn up in German. An English version serves information purposes only; the German version prevails.

(4) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
